Big changes are coming for casual workers and employers in Australia! The Fair Work Legislation Amendment (Closing Loopholes) Acts will significantly impact casual employment, with key changes taking effect in August 2024. Here's a breakdown of what you need to know:
• Clearer Definition - A new definition will determine casual status based on the reality of the employment relationship, not just the contract. This prevents misclassifying employees as casual when they work regular, ongoing hours.
• Employee-Initiated Conversion - After a set period (6 months or 12 months for small businesses), casual employees can request permanent positions if working a regular pattern of hours.
• Increased Protections - Employers can't dismiss or threaten dismissal to re-engage someone as casual. Penalties apply for misrepresenting employee status.
• Casual Employment Information Statement - A mandatory statement informing casual employees of their rights and entitlements will be required. Download this from fairwork.gov.au.
